이번주 주제는 school children의 job이 주제입니다.
학생들이 학업을 하면서 주중에 방과후 시간이나 주말일 이용해 일을 하는 것에 대한 찬반이 많이 있습니다.
긍정적인 측면으로는 노동의 가치를 배우고 경제체험을 통해 학교에서 배운 이론을 직접 체험할 수 있는 점, 여러 경험을 통해 자신의 꿈이나 재능을 발견할 수 있는 기회 등을 들 수 있겠습니다.
부정적인 측면으로는 학업에 방해가 될 수도 있고 여러가지 위험에 노출 되기도 하고, 노동력 착취나 인권침해, 안전사고의위험 등을 생각할 수 있습니다.

Schoolchildren in part-time work is something which divides opinion. It used to be normal in the UK but the trend is changing.
It seems fewer and fewer are these days, according to the statistics.
A Saturday job is the name we give to part-time work that teenagers do for extra money. As the name suggests, these jobs often take place on Saturdays – but not always.
'Saturday job' is general term we use to describe part-time work done by teenagers. The work might take place on Sundays or any day of the week, in fact!

On the average week I work nine hours, so two hours for two school nights and then I work four hours on a Saturday and two hours on a Sunday. And then in the school holidays I can work more.

But according to the latest statistics in the UK, that is all changing.
In order to work, they need a permit from the local authority and our data shows the number being issued has fallen from nearly 30,000 permits in 2012 to just 23,000 in 2016. Employers frequently bemoan the lack of work experience young people have. But teenagers are also facing pressure not to take up part-time jobs and to concentrate on their studies instead.
<청소년 근로기준법 : 근로시간>
1. 18세 미만인 자의 근로시간은 1일에 7시간, 1주일에 40시간을 초과하지 못합니다.
일반 성인근로자의 경우에는 1일에 8시간, 1주일에 40시간까지 근로가 가능하지만,
18세 미만인 근로자의 경우 1일에 7시간, 1주일에 40시간까지만 근로가 가능합니다(근로기준법 제69조).
18세 미만인 근로자에 대해 성인과 똑같이 1일에 8시간, 1주일에 40시간씩 근로를 시킨다면 1일 1시간씩은 연장근로에 해당됩니다.
2. 18세 미만인 자의 근로시간은 당사자 합의에 따라 1일에 1시간, 1주일에 6시간을 한도로 연장할 수 있습니다.
18세 미만인 근로자의 경우 1일에 7시간을 초과하거나(or) 1주일에 40시간을 초과한 근로는 '연장근로'입니다.
18세 미만인 근로자의 연장근로는 1일에 1시간, 1주일에 6시간까지만 가능합니다(근로기준법 제69조).
현실적으로 많이 보이는 형태를 예를 들어보면,
만약 월요일부터 금요일까지 매일 오전 9시부터 오후6시까지 근로했다면(12시 ~ 13시 점심시간)
1주일 간의 근로시간을 합산하면 40시간이지만,
1일의 근로시간이 8시간이므로 7시간을 초과한 1시간은 연장근로입니다.
따라서 [7시간 * 5일 = 35시간] 은 일반적인 근로와 마찬가지로 처리하면 되겠지만
[1시간 * 5일 = 5시간] 은 연장근로이므로 상시 근로자 5인 이상 사업장이라면 통상임금의 50%를 가산하여 지급해야겠지요.
3. 18세 미만인 자는 야간근로와 휴일근로가 금지됩니다. 다만 고용노동부 장관의 인가를 받으면 야간근로와 휴일근로를 할 수 있습니다.
원칙적으로 18세 미만인 자는 야간근로와 휴일근로를 할 수 없습니다.
(야간근로란 오후 10시부터 오전 6시 사이에 하는 근로를 말하고, 휴일근로란 '휴일'에 하는 근로를 말합니다)
다만 18세 미만인 자의 동의가 있는 경우 고용노동부 장관의 인가를 받으면 예외적으로 야간근로와 휴일근로가 가능합니다.
인가 신청은 지방 노동관서(고용노동청, 고용노동지청)에 신청합니다.
인가를 신청한다고 해서 반드시 승인이 되는 것이 아니라, 근로감독관 집무규정 제71조에 기준이 명시되어 있습니다.
4. 위 사항을 위반한 사업주는 형사처벌을 받을 수 있습니다.
근로시간의 제한을 위반한 사업주는 2년 이하의 징역 또는 1천만원 이하의 벌금에 처할 수 있습니다(근로기준법 제110조).
