Magna Carta -- a Root of Current Constitution
In June 1215, a small group of powerful nobles met King John of England. It’s because King John made the nobles pay heavy taxes to pay for his wars against the French and punished some nobles without proper trials. After days of arguing, the nobles forced King John to sign a document stating their rights to stop the king’s dogmatic decision making. This document is the Magna Carta, Latin for “Great Charter.”
The Magna Carta was very much a feudal document. This document was a list of nobles’ demands for reform. Although the document did not challenge the king’s right to rule, it firmly established the idea that the king had to obey the law of the land.
There were statements such as “No money or special tax shall be imposed unless the common council of the kingdom agrees,” “No free man shall be taken or imprisoned, nor his property taken, outlawed or in any way destroyed except by the legal judgment of the peers and the law of the land.”
The kings that followed King John also needed to raise money for different reasons. To raise this money through taxes, the kings needed the support of the wealthy nobles and townspeople. The Magna Carta prohibited the collection of taxes without approval of the “common council,” which was made up of great nobles, church leaders, knights and townspeople. This group of people became known as the Parliament.
The Magna Carta’s real significance went far beyond the dispute between King John and his nobles. For the first time in history, a king of England was bound by the law. He could not order as he wanted. His decision needed certain legal process in the Parliament to be effective. The Magna Carta became the root of current constitutional law in the English speaking world. Magna Carta influenced the development of the common law and many constitutional documents including the United States Constitution.
마그나 카르타 – 헌법의 시초
1215년 6월에 권력이 있던 몇몇의 귀족들은 잉글랜드의 존 왕을 만났다. 그 이유는 프랑스와의 전쟁에 필요한 돈을 충당하기 위해 존 왕이 귀족들로 하여금 많은 세금을 내게끔 하였고 적절한 재판 없이 귀족들을 벌했기 때문이다. 몇 일 동안의 논쟁 후에 귀족들은 존 왕으로 하여금 그의 독단적인 결정에 대한 자신들의 권리를 적어 놓은 문서에 서명하게끔 하였다. 이 문서는 대헌장이라는 뜻의 라틴어인 마그나 카르타이다.
마그나 카르타는 매우 봉건적인 문서였다. 이 문서는 개혁에 대한 귀족들의 요구가 적인 목록이었다. 이 문서가 비록 왕의 통치에 대한 권리에 맞서지는 않았지만 왕도나라의 법을 준수해야 한다는 점을 명확하게 하였다.
문서에는 다음과 같은 문구들이 있었다: “어떠한 돈이나 특별 세금도 국가의 시 의회가 찬성하지 않는 한 부과될 수 없다,” “ 어떠한 자유인도 주변인들의 법적 판단이나 나라의 법이 아니고서는 끌려가거나 감옥에 갇히거나 재산을 빼앗기던가 보호받지 못하던가 파괴 될 수 없다.”
존 왕 후세의 왕들도 여러 가지 이유로 돈을 끌어 모을 필요가 없었다. 세금을 통해 재원을 조달하기 위해서는 왕들은 부유한 귀족들과 시민들로부터의 지원이 필요했다. 마그나 카르타는 지위 높은 귀족들, 종교 지도자들, 기사들, 시민들로 구성된 시의회의 승인 없이 세금을 거둬들이는 것을 금지했다. 이 사람들의 모임은 국회라는 이름으로 알려지게 되었다.
마그나 카르타의 진짜 중요성은 존 왕과 그의 귀족들간의 논쟁을 넘어선다. 역사상 처음으로 잉글랜드의 왕이 법에 의해 구속되었다. 그는 그가 원하는 데로 마구잡이로 지시를 내릴 수 없었다. 그의 결정이 효력이 있으려면 국회에서 적절한 법적 절차가 필요했다. 마그나 카르타는 현재 영어권 국가들의 헌법의 기초가 되었다. 마그나 카르타는 미국의 헌법을 포함한 많은 헌법 조문들과 관습법의 발전에 영향을 끼쳤다.
